What is Form I-864?

Form I-864, Affidavit of Support Under Section 213A of the INA, is a contract in which a sponsor promises financial support to an immigrant. It is required in many family-based green card cases and is filed with the immigrant's application or provided to the Department of State during consular processing.

The form asks about the sponsor's household, income, tax returns and sometimes assets, and a joint sponsor can be used in some cases. Whether income is enough, or whether a joint sponsor is needed, is decided under the official rules — OG does not make that determination.

Are you immigration attorneys?

What does a sponsor need to prepare?
Proof of citizenship or permanent residence, a photo ID, the household members' details, the most recent tax return(s) and income documents such as pay stubs or W-2s, and information about the person being sponsored. The instructions list exactly which tax years and evidence are requested.
Can you tell me if my income is enough?
No. We organize your documents, but we do not decide whether a sponsor meets the requirements or whether a joint sponsor is needed. That is determined under USCIS's official rules; for advice about your situation, consult a licensed immigration attorney.
Do you file the I-864 for the sponsor?
No. We prepare it from the information the sponsor provides; the sponsor reviews and signs it and files or provides it as the case requires.
